By placing an order at Backwoods Gallery Pty Ltd, you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at Backwoods Gallery Pty Ltd for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

PERSONAL INFORMATION

All personal information you provide us with or that we obtain will be handled by Backwoods Gallery Pty Ltd as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalogue to you. The information you provide is only available to Backwoods Gallery Pty Ltd and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Backwoods Gallery Pty Ltd to delete or correct the information held about you. By accepting the Backwoods Gallery Pty Ltd Conditions, you agree to the above.

FORCE MAJEURE

Events outside Backwoods Gallery Pty Ltd's control, which is not reasonably foreseeable, shall be considered force majeure, meaning that Backwoods Gallery Pty Ltd is released from Backwoods Gallery Pty Ltd's obligations to fulfil contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

PAYMENT

All products remain Backwoods Gallery Pty Ltd's property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognised before confirming the purchase. If you are under 18 years old you must have parents' permission to buy from Backwoods Gallery Pty Ltd.

All transfers conducted through Backwoods Gallery Pty Ltd are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.

LOCAL TAXES

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

COOKIES

Backwoods Gallery Pty Ltd uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the website to identify and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. Backwoods Gallery Pty Ltd reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is mispriced, out of stock, discontinued, or otherwise unavailable at the price listed Backwoods Gallery Pty Ltd has the right to cancel the order and refund any amount paid in the best way. Backwoods Gallery Pty Ltd shall also notify the customer of equivalent replacement products if available.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - THIRD PARTY SERVICE PROVIDERS

Our store is hosted on Squarespace Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Squarespace’s data storage, databases and the general Squarespace application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Stripe stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. 

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. RETURNS & REFUNDS

Backwoods Gallery Pty Ltd is committed to ensuring the satisfaction of our art collectors. That's why once you’ve received an original artwork, we'll give you 7 days to decide whether or not you’d like to keep that artwork or return it for a refund or exchange.

Original artworks, editions and products are valid for return 7 days after the date you received the order.

You may return any eligible item, provided that it is returned to us in its original condition and packaging.

Only regular priced items may be returned, exchanged or refunded, unfortunately sale items cannot.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, books, newspapers or magazines cannot be returned. We also do not accept products that are textile, intimate or sanitary goods, hazardous materials, or flammable liquids or gases such as paint.

There are certain situations where refunds are not granted:

  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error
  • Any item that is returned more than 7 days after delivery
  • Any item that was on sale at time of purchase

To complete your return, we require a receipt or proof of purchase.

To return your product, you should mail your product to: 25 Easey Street, Collingwood, VIC, 3066 with trackable shipping and insurance applied.

You will be responsible for paying for your own trackable shipping and insurance costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return trackable shipping and insurance will be deducted from your refund.

If you are shipping an item, you must consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

Please do not send your purchase back to the artist or producer.
